6.      Subscription to our Newsletters

On the website of Marketingnfinance, users are given the opportunity to subscribe to our newsletter. The input form used for this purpose specifies the personal data that will be transmitted, as well as when the newsletter subscription request is made by the user.

Marketingnfinance regularly informs its customers and business partners through a newsletter about company offers. A user may only receive the newsletter if (1) they have a valid email address, and (2) they register for the newsletter. A confirmation email will be sent to the registered email address as part of a double opt-in process to verify that the owner of the email address is authorized to receive the newsletter.

During the newsletter registration, we also collect the IP address assigned to the user by their internet service provider (ISP) as well as the date and time of registration. This data is necessary to prevent misuse of the email address and to ensure legal protection for the company.

The personal data collected for the newsletter subscription will only be used to send the newsletter. Additionally, subscribers may receive emails regarding necessary updates, such as changes to the newsletter or technical issues related to the service. We do not share any personal data collected through the newsletter with third parties. Users may unsubscribe from the newsletter at any time. They can also withdraw their consent to store their personal data, and this can be done through a link in each newsletter or directly on the website of Marketingnfinance.

7.      Newsletter Tracking

Marketingnfinance’s newsletter includes tracking pixels, which are small graphics embedded in the email that help track user engagement. This allows us to analyze the effectiveness of our marketing campaigns. Through these tracking pixels, Marketingnfinance can determine if and when an email was opened, and which links within the email were clicked.

Any personal data collected through these tracking pixels is stored and analyzed by Marketingnfinance to optimize future newsletters and tailor the content to user interests. These data are not shared with third parties. Users can revoke their consent for this data collection at any time, and upon withdrawal, the data will be deleted.

8.      Contact Options via the Website

The Marketingnfinance website includes information that facilitates quick electronic contact with us, including an email address for general communication. If no contract is formed, the application documents will be automatically deleted within two months after the rejection notification, unless there are other legitimate interests on the part of the controller preventing this. For instance, legitimate interests may include the need to retain records for evidence in the context of a dispute under the General Equal Treatment Act (AGG).

13. Data Protection Provisions Regarding the Use of Facebook

On this website, the controller has integrated components from Facebook, a social network.

A social network is an online community that allows users to communicate and interact virtually. These platforms often enable users to exchange opinions and experiences or share personal and business information. Facebook provides users with the ability to create personal profiles, upload photos, and connect with others through friend requests.

The operator of Facebook is Facebook, Inc., located at 1 Hacker Way, Menlo Park, CA 94025, USA. For users outside of the United States and Canada, the responsible entity is Facebook Ireland Ltd., at 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Whenever a user visits a page on this website that includes a Facebook component (e.g., plugins), their browser automatically requests the corresponding component from Facebook. A list of all available Facebook plugins can be found at Facebook Developer Plugins. During this process, Facebook becomes aware of which specific page of our website the user is visiting.

If the user is logged into Facebook while visiting our website, Facebook can track the specific page being viewed for the entire duration of the visit and associate this information with the user’s Facebook account. If the user interacts with the Facebook components (such as liking a post or submitting a comment), Facebook associates this data with the user’s Facebook profile and stores the information.

Facebook receives information about the visit to our website whenever the user is logged into Facebook while browsing our site, whether or not the user interacts with the Facebook components. Users can prevent this by logging out of Facebook before visiting our website.

Facebook’s privacy policy, available at Facebook Privacy Policy, explains how Facebook collects, processes, and uses personal data, as well as the available privacy settings for users.

14. Data Protection Provisions Regarding Google AdSense

This website integrates Google AdSense, an online service that enables the placement of ads on third-party websites. Google AdSense uses algorithms to display ads that are contextually relevant to the content of the respective webpage. It also allows interest-based targeting through the creation of individual user profiles.

The operator of the Google AdSense component is Google Ireland Limited, located at Gordon House, Barrow Street, Dublin, D04 E5W5, Ireland.

Google AdSense places a cookie on the user’s device, allowing Google to track the use of our website. When a user visits a page with an integrated Google AdSense component, their browser transmits data to Alphabet Inc. for ad placement and commission settlement purposes. Through this technical process, Alphabet Inc. learns personal information, including the user’s IP address, which helps determine the origin of visitors and clicks, and allows for commission settlements.

Users may prevent the placement of cookies by adjusting their browser settings. Such changes will also block Alphabet Inc. from setting cookies on the user’s device. Users can also delete cookies set by Alphabet Inc. through their browser or other software.

Additionally, Google AdSense uses tracking pixels, which are miniature graphics embedded in webpages to log and analyze user activity for statistical purposes. This allows Alphabet Inc. to track the user’s activity on the site, including which links are clicked.

Through the use of Google AdSense, personal data (such as the IP address) is transferred to Alphabet Inc. in the United States for processing. Alphabet Inc. may also share the collected data with third parties.

For more information, users can visit Google AdSense.

15. Data Protection Provisions Regarding Google Analytics (with Anonymization Function)

This website integrates Google Analytics with the anonymization feature. Google Analytics is a web analytics service that collects and analyzes data about how users interact with websites. This service tracks data such as the referral source, which subpages were visited, and how often and for how long pages were viewed. Web analytics helps improve website performance and optimize online advertising.

The operator of Google Analytics is Google Ireland Limited, located at Gordon House, Barrow Street, Dublin, D04 E5W5, Ireland.

Google Analytics uses the application “_gat._anonymizeIp,” which anonymizes the user’s IP address by truncating it when the website is accessed from within a European Union member state or another signatory state of the Agreement on the European Economic Area.

Google Analytics aims to analyze website traffic. Google uses the collected data to generate reports for the website operator, which helps assess the effectiveness of website activities and improve the site’s performance.

Google Analytics sets a cookie on the user’s device. With each visit to a page on our website that contains Google Analytics, the browser sends data to Google, which uses it for online advertising purposes and to settle commissions. This data includes personal information such as the IP address of the device, which helps Google understand where visitors are coming from and track clicks for commission purposes.

This cookie stores information such as the time of access, location of access, and the frequency of visits to our site. When visiting our website, this personal data, including the user’s IP address, is transferred to Google in the United States and stored there. Google may share this data with third parties.

Users can prevent the setting of cookies through their browser settings at any time. This would also stop Google Analytics from placing a cookie on the user’s device. Users can delete cookies already set by Google Analytics through their browser.

Users also have the option to opt-out of Google Analytics by downloading and installing a browser add-on available at Google Analytics Opt-out. This add-on prevents Google Analytics from sending data about website visits to Google. If users later delete, reformat, or reinstall their device, they will need to reinstall the opt-out add-on.

For more information, users can review Google’s privacy policy at Google Privacy Policy and Google Analytics terms at Google Analytics Terms.

The legal basis for processing personal data depends on the specific processing activities being undertaken. In cases where consent is required, processing is based on Article 6(1)(a) of the GDPR. If processing is necessary for the performance of a contract, such as when providing goods or services, the legal basis is Article 6(1)(b). This applies to situations like inquiries related to our products or services.

In instances where processing is required by law (e.g., for tax purposes), it is based on Article 6(1)(c). In rare cases, processing may be necessary to protect vital interests, for instance, in emergency medical situations, based on Article 6(1)(d). Finally, processing may also occur under Article 6(1)(f) if it is required to pursue legitimate interests that do not conflict with the fundamental rights and freedoms of the data subject.

27. Legitimate Interests Pursued by the Controller or a Third Party

Where personal data processing is based on Article 6(1)(f), our legitimate interest lies in conducting our business to the benefit of our employees and shareholders.

If personal data is required to enter into a contract with us, the data subject must provide such data. Failure to do so could result in the inability to complete the contract.

Before providing any personal data, the data subject can consult with one of our employees, who will explain whether the provision is legally or contractually required, and what the consequences would be if the data is not provided.

30. Automated Decision-Making

As a responsible company, we do not use automated decision-making or profiling in our processes.
